Innovating to circumvent prior art would be a good idea if it produced a better or just as good mousetrap at a lower cost. In this case, the market correctly gets split. If the circumvention is inferior or more costly than the original innovation, the market needs to be allowed to dictate it has no value. Gridlock, stalemate and regression only come about from abnormal market intervention.

As with patents and competition, doesn't innovation and open markets also go hand-in-hand? Can you have one without the other?
