You can question your terrorist mastermind. Only Common article 3 is deemed to apply.



What McCain is proposing is useful, I think, updating the Geneva conventions to deal explicitly with terrorist prisoners, and saying explicitly that they get Common Article 3 protections but NOT Fourth Geneva Convention protections.

However, the people who are yelling about Gitmo are yelling because we have not applied the Fourth Geneva Convention, giving the prisoners there the rights of POWs - "name, rank and serial number".

Alternately, they are yelling because we have not given the prisoners in Gitmo full access to the American court system, as if they were American citizens caught in a burglary.
