bd - Nokia files for Qualcomm patent exhaustion.

Nokia believes its long years of paying Qualcomm may be at an end. The Helsinki-based company has filed a Patent Exhaustion Case against the US vendor. In the German and Dutch courts, the Finns will argue that Qualcomm’s European patents are exhausted in respect of products placed on the EU market with a Qualcomm licence.

bd - Nokia says that if its claim succeeds, Qualcomm would be prevented in Europe from enforcing its respective patents in relation to Nokia handsets incorporating such chipsets.

The complaints were filed in the Regional Court of Mannheim (Germany) and in the Hague District Court in the Netherlands.

The companies are fighting hammer and tongs over renewal of a long standing arrangement on IPR sharing that is due to expire April 9.

Nokia is seeking a much lower rate for using Qualcomm's parents and has threatened to stop paying altogether if there is no agreement by the date of the expiry if the current contract
