IMO --- aside from all the blather about extraneous matters --- all the 5-4 decision indicated was that a narrow majority of the Court came down on the side of NOT being judicial activists.

Instead, they simply interpreted the LETTER of the EXISTING FEDERAL LAW... which, in this case, was the law that created and authorized the E.P.A.

Now, if anybody doesn't want the E.P.A.'s purview to include certain emissions... all they need to do is change the law to accomplish that by *excluding* those compounds.

(But --- supporting judicial activism, creating new 'law' out of whole cloth just because you come down on one side or the other of a policy question --- is the WRONG WAY to go about it, Peter.)
