"Nokia may have brought Vitelcom to court for failing to draw up any sort of contract at all for using Nokia patents."

Currently this document is being used to bolster the royalty rate argument but what about the GSM/GPRS/EDGE cases? If others are expected to draw up contracts for use of patents why then did NOK fail to do so with respect to Q? This sounds like we have both sides of the coin covered here.
