Then the Nokia investors would do the same. Unlikely this would resolve the dispute and perhaps would only delay the eventual compromise. Filing more law suits will only entrench each companies animosity towards one another and further delay any resolution.

The only concern that Nokia has in the near term is the possibility of the ITC or another part of the U.S. government issuing an injunction preventing them from utilizing Qualcomm's IP. In the long term, once these law suits actually are heard they may be held liable for punitive damages, but that resolution make take considerable time. It's also likely that Qualcomm would forgive the punitive damages as part of contract negotiations anyway.

As a Qualcomm investor, I believe that the best result would be an immediate compromise which includes settlement all of suits. I believe that Qualcomm would be victorious in the court room, however the length of time to accomplish this is not in Qualcomm's or its investor's best interest.

The longer we don't hear of any new legal maneuvers the better in my opinion. That means that both parties are still negotiating.

If NOK continues to use Q ipr without paying royalties during these "ongoing negotiations", there should be some serious consideration given to filing a class action suit against NOK on behalf of Q investors.

Case in not ripe. Negotiations ongoing. No damages unless you've sold. Bottom line, no serious consideration need be given @ this time.

If you're a position trader, these are the risks inherent taking positions in this stock. If you're a long term investor, be patient, you'll be rewarded, as in all likelihood, settlement will eventually be reached. Might take a quarter or two, but should happen. Stock will rise easily pass recent high of 53. JMO.
