I can tell you I would have liked to see the SEC on the lawsuit but in a civil complaint like this the SEC has some level of immunity. The lawsuit is very real as the evidence within the lawsuit shows. Simply because the SEC is not listed as a defendant does not mean that pressure will not be put on the SEC from a different angle.
