The e-mails are likely there still. Hard drives need to be over-written about 36-times before the magnetic information is completely erased. If you want to do something criminal and erase all evidence, that's something you need to keep in mind. I doubt they went to that much trouble.

Furthermore, when there is room on a hard drive, deleted items are only marked for deletion. They are not deleted right away, although they show up as deleted when you look at the files.

If they wanted to, any outside disaster recovery service could recover those e-mails pretty easily. The IRS, FBI, and NSA also could do it pretty easily.

Doesn't the FBI grab every e-mail everywhere anyway (i.e. Carnivore)? Just ask them for everything.
