As far as I know securities laws only permit you to buy up to 5% once you have announced a bid, so if they have been buying, they are capped at 5%. The press release announcing the bid never made mention of them owning any shares before the bid was made. Most of this buying is probably arb funds, hedge funds ,specs. etc.
