Cho would have had to have been involuntarily committed to a psychiatric hospital AND the State of VA would have had to also notify the FBI to get the data into the NICS instant background check database. Neither happened. Cho got outpatient and even if he was involuntarily committed, the FBI/NICS never would have gotten the data. VA claims they don't have the resources to submit that data.
