Rich, giving Nokia a 1% discount, and therefore everyone else, in a FRANDly and most-favoured-nation way, would be a major hit to our royalties. I don't understand why that's necessary.

A 1% net reduction in Nok's royalty rate would not result in MFL problems. It would only result in MFL problems if Q reduced their rate from the standard, whatever it is rate. However, Q will not do that. What they may do is agree to license NOK's patents for WCDMA at a 1% rate in return for NOK agreeing to a new Q license at Q's standard rate. I would take this deal in a heartbeat. Yeah, it would cost some loss of Royalty income, but it would result in substantially reducing the 100 million dollars being paid to the lawyers. And, the almost immediate increase of a few billion in capitalization.

Probably not going to happen, but it is a scenario that I would be very happy with.

With QCOM using no Nokia patents, QCOM doesn't have dirty hands going into legal disputes. That's great. I wonder if it's true. If not true, then I suspect making a knowingly false claim is another legal mistake.

Q has never said they use no Nokia patents. What they said is they believe they are using no Nokia patents. The burden is on Nokia to convince Q that they are using their patents and if Q still does not believe it then to prove it in court.

This, in no way, indicates that Q has unclean hands. I am not worried about this potential.
