I think you might have a good circumstantial case that would hold up in Court. He can try to explain away his reaction, but his reaction is suggestive of guilt. I think the DA ought to charge him and see what shakes out of it.

Geez...that sounds like indicia of guilt to me. You should file your civil case against him and make him take the 5th. While you can't comment on exercise of the 5th Amendment rights in a criminal court, you can comment on it in a civil action. At least that's the rule in CA.

You are a far better person then me. Once it became obvious that he had done it by his reaction I would have likely opened myself up to a lawsuit by opening up a can of whoopass on him.
