I thought you meant that it wasn't different then detaining prisoners who wage war against us. I agree it is different then rounding up criminals (which isn't to say that we have not rounded up a lot of criminals).

Some Al Qaeda terrorist who has killed innocent people, would be both a criminal and a terrorist, and presumably someone who has also waged war against us (at least in a support role) so he would be the trifecta.

Some one opposing the presence of US forces in Iraq through armed attack, who makes no deliberate effort to target civilians, would be a combatant, and an enemy of the US, but not necessarily a criminal or terrorist.

Some one robbing a bank in Iraq would just be a criminal. (Unless the bank robbery is to fund insurgency and/or terrorism)

I don't think we have detained many of the last group. The detainees would be the first and 2nd.
