Where German POWs in an "American gulag" during WWII. Would they have been if it took us decades to win? Its not an American gulag. Gitmo isn't run like the Gulag, or for similar purposes to the gulag. Its actions, purposes, and moral nature are entirely distinct.

The idea of giving captured enemy their freedom before the war ends, so that they can go back to fighting and killing your side again, is one of the most foolish ideas that I've ever seen supported by any great number of educated people. Its really hard to imagine otherwise reasonable people supporting it, but I guess I have to get my head around imagining it, because for some reason a number of them do. And yes requiring proof beyond all reasonable doubt combined with multiple levels of appeal, amounts to releasing the captured enemy, at least the majority of them.
