I wonder what would happen if they called it a smoking establishment that also serves drinks, and eats, instead of a bar. I doubt that would be effective. Some jurisdictions would say "its a public area", and ban smoking in "public areas". Others would just outlaw "smoking establishments" (either directly or by requiring a license and then not granting any), others might allow the smoking establishments but would forbid them from serving alcohol, and perhaps even food, likely making the business untenable.
