Which people? The ones who are suspected Al-Qaeda or the one's suspected of complicity in torture? Arrest and investigate those suspected to be AQ. Hold them while they are under investigation, charge them when you have evidence... no substantial evidence .... hold them until the war with AQ is over or until they are cleared. Investigate the charges of torture. If they are found to be credible, charge the suspects. Next question...

btw, I don't really give a hoot about the law suit. I think criminal charges should have been filed, so I may be arguing over nothing.
