Fitzgerald "pulled his punches" because there was no underlying crime. Plame wasn't covert under the meaning of the statute. If this wasn't true , the CIA wouldn't have confirmed her employment when asked. With no underlying crime, he should have ended the investigation. Instead he chose to go after a perjury/obstr of justice charge based on conflicts between the testimonies of Libby and a handful of reporters.
