It's not a civil liberties issue. It's exception reporting, the same way the IRS flags you when your reported income does not agree with your W2s and 1099s on file. If the SSA sees income under one SS# for two different names, that's an exception which should be resolved.

Also, the SSA shares information with the IRS which has enforcement and prosecution powers. There is no reason why it can't share certain exception reporting info with the proper immigration authorities.

I'd think a pattern of bogus SSN's showing up (dead people, false numbers, etc.) for a single employer would be more than sufficient probable cause to allow law enforcement to be alerted.
