Other ways of getting in might have been covered in other ways. Even if they where not covering a major one is not a bad thing that someone should get punished for, even if it doesn't solve the problem.

And he isn't being sued for the owner because he did a poor job of pest control. He's being attacked because he's advertising that he is controlling pests without a pest control license. If he really is not doing what he says he will do he could be attacked for false advertising, or potentially breach of contract, but that isn't what is happening here. He may well have done an effective job, and this case doesn't rely on the idea that he did not. Even if he did a perfect job and it could be proven he would still face the same problem.
