"Less than market rates" means you can't hire anyone (or at least not without forcing them). Market rates are defined as what the market will accept.

I guess maybe you mean "less than what the market rates would have been in their absence". The implied argument there being that these workers decrease the market rate. I think a strong argument can be made that they do indeed decrease this rate. OTOH to the extent that this is a concern it isn't a concern for the immigrant workers (who are making more than what they would make if they didn't enter the country), they benefit. I find it hard to square the idea of "taking advantage" of someone when your improving their situation, and when they accept the job voluntarily.
