The point is they aren't less then market rates. "Less than market rates" means you can't hire anyone (or at least not without forcing them). Market rates are defined as what the market will accept. I guess maybe you mean "less than what the market rates would have been in their absence". The implied argument there being that these workers decrease the market rate. I think a strong argument can be made that they do indeed decrease this rate. OTOH to the extent that this is a concern it isn't a concern for the immigrant workers (who are making more than what they would make if they didn't enter the country), they benefit. I find it hard to square the idea of "taking advantage" of someone when your improving their situation, and when they accept the job voluntarily.
