Putting the country under martial law is generally not required when you are at war.

As for declaring war, I don't have a problem with the concept, except it's just not the way we do things anymore. Korea, Vietnam, Gulf War, Iraq, Afghanistan, and smaller conflicts, all undeclared. Maybe you want to change that pattern, maybe changing it would be a good idea, but the claim that all these conflicts where not wars isn't a reasonable one IMO.
