Also Novak was not the only reporter to be told of Plame's identity by an administration official, nor was he the first.

The first known case of her outing was Libby telling Judith Miller.

And finally, Fitzpatrick said that because of Libby's lying and obstruction of justice (for which Libby was convicted), Fitzpatrick could not determine if the underlying crime had been committed or not.

That's what Fitzgerald concluded.
