Earth BioFuels settles with creditors

Nov 15, 2007 (The Dallas Morning News - McClatchy-Tribune Information Services via COMTEX) -- Dallas-based Earth BioFuels Inc. has settled with a group of creditors who tried to force the company to liquidate in July.
The company, which licenses the organic-based diesel fuel BioWillie, said in regulatory filings that it had reached an out-of-court settlement with investors including Castlerigg Master Investments Ltd. of the British Virgin Islands.

Castlerigg and others agreed to drop their effort to force Earth BioFuels into bankruptcy in exchange for being owed just over $100 million collectively, with interest and fees still accumulating.

As part of the agreement, Earth BioFuels chief executive Dennis McLaughlin has agreed to a limited personal guarantee for an unidentified portion of the debt. The company filed the documents Tuesday night.

Earth Biofuels admitted in court that it failed to meet some of the obligations related to the investor financing and will not contest the $100 million figure it owes, according to the filings.

The company lost $21 million through the first six months of 2007 on revenue of $4.8 million. It has been hurt by market factors surrounding the biofuels industry and needs new financing to continue operations, according to other regulatory filings. Its accountants issued a going concern warning in May after the company restated some of its financials.

On Wednesday, the company asked the Securities and Exchange Commission for permission to delay filing its quarterly financial statements, saying its executives have been too busy with other matters to file them.

Messages left with lawyers for Castlerigg weren't returned Wednesday. Earth Biofuels spokeswoman Shawne Horn said the company expects to have a news release soon.

Shares of Earth Biofuels rose three-tenths of a penny to 4.7 cents in trading Wednesday, having lost 95 percent of their value this year.

Earth Biofuels LNG Subsidiary Announces Contract Renewal

DALLAS, Nov 16, 2007 (BUSINESS WIRE) -- Earth Biofuels, Inc. (OTCBB:EBOF) today announced that its subsidiary, Applied LNG Technologies ("ALT") has renewed a three year liquefied natural gas supply agreement with the City of Redlands (California).
The City of Redlands utilizes liquefied natural gas ("LNG") as transportation fuel for its municipal fleet vehicles, and has built an LNG and compressed natural gas ("CNG") refueling station for public use within its city limits.

"This renewal exemplifies our recent successes in growing our profitable LNG business, especially in the California markets," stated Earth Biofuels CEO, Dennis McLaughlin. "We are now in the process of expanding our product availability to make LNG available in major cities outside of California."

LNG meets California's strict emission standards and is now more readily available for use by commercial vehicles, heavy-duty trucks, utility companies, fleets, light-duty trucks and consumer CNG vehicles. Vehicles fueled by the transportation grade LNG produce approximately one-sixth of the nitrous oxides (NOx) and up to 15 percent less greenhouse gases than comparable petroleum diesel fueled vehicles.

"We are pleased to be able to offer the public access to clean, domestically produced LNG and CNG in a convenient location and ALT has been a great partner in this effort," said Gary Van Dorst, Solid Waste Manager for City of Redlands.

Through California's South Coast Air District and Air Quality Management grants, the City of Redlands will operate 20 of its 32 municipal vehicles on LNG/CNG fuels by its fiscal year end.

"This is a win-win agreement because it allows ALT to provide LNG on a long term basis and gives the City of Redlands piece of mind knowing that they have stability regarding their LNG supply," said Kevin Markey, Vice President, ALT, Inc.

Petition for Bankruptcy Against Earth Biofuels Dismissed

DALLAS, Dec 11, 2007 (BUSINESS WIRE) -- Earth Biofuels, Inc. (OTCBB:EBOF) today announced that the petition for involuntary bankruptcy filed against the Company on July 11th of this year was dismissed yesterday, December 10, 2007, by the U.S. Bankruptcy Court for the District of Delaware.
