Whole Foods submitted the postings to the FTC, months ago. The postings may have been and probably were made with the company's (and board's) awareness.

Unless they went through the years of Yahoo postings and printed them out to submit to the FTC. Unlikely, IMO. Were they not aware at all, and then Mackey said he made postings for years on Yahoo and we ought to find them and print them and include them in the 20,000,000 pages we submit?

My guess, is that Whole Foods attorneys knew about this and determined it was not illegal.

Criticizing a competitor, even belittling a competitor is common practice. Even later deciding that something you thought was worthless or even overpriced or even a short sale was later something valuable or fairly priced or a potential "buy" is also commonplace.

Anyway, the market spoke clearly today that it is a non-event.

The SEC has initiated an informal inquiry into Mackey's antics. I suppose we'll find out sooner or later.
