I was thinking the same thing. I would bet dollars to donuts that there is a clause in the agreement that says if the ITC ban is overturned on appeal, or Vetoed the agreement is void as well.

Furthermore, if Qualcomm does end up entering a license with Broadcom, I'd expect that the Verizon deal would also be rendered redundant and moot due to Ron's point about patent exhaustion.

i didn't read anything about a minimum dollar commitment to brcm.. so this could all be back up if appeals fail etc.

Another similar deal with Sprint and Alltel would effectively nullify the ITC ban for EVDO handsets. Maybe AT&T will then want the same deal for WCDMA. What a coup! BRCM defeats the injunction by itself. But gains a goodwill foothold with the base of Q's food chain. And presumably more leverage in the negotiations with Q. Please tell me this won't happen.

But the deal isn't just for the ITC patent. It includes the patents from the Santa Ana trial too.
