one of his major arguments in his first post is exactly the one I've been making on this issue for a long time, that many "public spaces" are really private. Yes, technically, but... "Where the market fails to provide it should never be enough on its own to allow us to just shrug our shoulders, say “well market forces have spoken”, and so justify the status quo and signal the end of the debate." It's a good point. "in this instance the smoking ban 'breaks' a Prisoner's Dilemma," Also a good point.
