You neglected to mention that potential witnesses for the defense, namely some stoned birds, were still unavailable at the scheduled time and date for the deposition because of an incurable rash allegedly caused by external exposure to a mixture of an aids creme and a better-than-sugar sweetener...

MS. MONRO: We’re on the record at 10:20 on September 7th, 1999. We are at the U.S. Attorney’s office in Las Vegas, Nevada. My name is Meredith Monro and with me is Michael MacPhail. We are both officers of the Commission for purposes of this proceeding.
Would you please raise your right hand, sir?

was called as a witness and, having been first duly sworn, was examined and testified as follows:

MS. MONRO: Mr. Sylver, this is an investigation by the united States securities and Exchange Commission in the matter of Amazon Natural Treasures, Inc. to determine whether there have been any violations of certain provisions of the federal Securities laws. However, the facts developed in this investigation might constitute violations of other federal or state, civil or criminal laws.
Now, prior to the opening of the record you were provided with a copy of the Formal Order. This Formal Order will be available for your examination during the course of the proceeding.
Have you had an opportunity to review the formal order?

THE WITNESS: Yes.

MS.MONRO: Also prior to the opening of the record, you were provided with a copy of SEC Form 1662.

THE WITNESS: Right, you sent that earlier.

MS. MONRO: I did. Have you had an opportunity to review the form?

THE WITNESS: Yes.

MS. MONRO: A copy of this notice has been marked as Exhibit 1.

(SEC Exhibit No. 1 was marked for identification.)

MS. MONRO: We can go off the record for a second.

THE WITNESS: I have this. Now, this is on do not disturb and only for emergencies it they do something to the office.

MS. MONRO: Okay.

THE WITNESS: Because it’s very important if they shoot or if something happens, they’ll call me.

MS. MONRO: Before we go any further, could you please state and spell your name for the record?

MS. MONRO: Do you have any middle initial?

THE WITNESS: A.

Ms. MONRO: I’m not sure whether I’d asked you yet. Have you had an opportunity to read Exhibit Number 1?

THE WITNESS: Yes, yes.

MS. MONRO: Do you have any questions?

THE WITNESS: No.

MS. MONRO: Okay. Mr. Sylver, you have the right to be accompanied and represented and advised by counsel. This means that you say have an attorney present and that your attorney can advise you before, during, and after your examination here today. Do you understand that?

THE WITNESS: Yes, I understand.

MS. MONRO: Since you are not represented by counsel here today, there are certain matters discussed in Exhibit 1, which is SEC Form1662 that I want to highlight for you.

THE WITNESS: Okay.

MS. MONRO: First, do you understand that upon your request, these proceedings will be adjourned so that you may obtain counsel?

THE WITNESS: Yes.

MS. MONRO: Do you understand that the statutes set forth in the Exhibit 1 provide criminal penalties for knowingly providing testimony or knowingly using false documents in connection with this investigation?

THE WITNESS: Yes.

MS. MONRO: Do you understand that you may assert your rights under the Fifth Amendment to the Constitution and refuse to answer any question that may tend to incriminate you?

THE WITNESS: Yes.

THE WITNESS: How come I have a different color badge?
