If "unlawful combatant" is the third paradigm, then where is the infrastructure to deal with them? It's the same infrastructure that deals with lawful combatants, duh. The military justice system. They get a hearing to determine their status, and then they get a firing squad. It's the same treatment that a State combatant out of uniform would receive if caught - as a spy or sabateur. Hearing, shot or hung. Then why haven't we shot them? Political weakness.
