They've been trying to make terrorism a legal matter forever.

I know that. And they will keep doing that until the paradigm is established.

My point is that the question of what to do with terrorists is novel so we don't have established protocols for it. As long as it remains unsettled, you'll have people who say we should use the criminal justice system, people who say we should use the military justice system, and people who say we should either shoot them or let them rot. Nowhere do we even have an established definition of what "them" is. So we're still getting articles published encouraging us to take one route or another, such as the one that started this discussion.

The answer is that terrorists aren't civilians and they're not soldiers either. They're terrorists and they don't deserve the protections for civilians or soldiers.
