That struck me too. With the Democratic party in the pocket of the trial lawyers, I can't imagine any plan they come up with eliminating malpractive lawsuits. Thus malpractice insurance would continue as well. Only I guess doctors and nurses would find it harder to pay for if their billings are held down.

As of 2004, thirty four states have some kind of cap on malpractice suits. I suspect that figure is higher now. Paying malpractice insurance is part of doing business as a doctor. If doctors didn't screw up, there wouldn't be a need for that kind of insurance. Besides, insurance costs have gone up considerably for every profession, not just doctors.
