To the extent I understand your point, I think I agree with it.

Our rights are not limited to legally granted rights. To the extent that a government abuses or ignores people's natural rights to a sufficient degree people have the right to resist.

But I don't think court decisions should be made on the basis of non-legal natural rights. As much as I might like any powerful force, including courts, protecting my natural rights, they might decide on an entirely different set of "rights" and enforce them in ways I might find objectionable. Allowing them to decide what rights are, and enforce the decision gives them too much power.
