Maurice I sure hope you are WRONG on the amount of the sanctions. The unenforcibility of Q's patent will cost Q billions. Judge Rudi thinks he's a KING that's for sure.
It's throroughly disgusting situation.

Any penalty in the billions will be overturned IMHO. The punishment just doesn't fit the crime. QCOM obviously doesn't have a very good internal legal process and screwed up. I understand the Judge is pissed, but emotions should not enter his ruling. Hopefully, he will cool down and realize the damage to QCOM's reputation and market cap is punishment enough.

MW - No-one who reads Judge Rudi's judgement can be in any doubt that whatever is coming is goign to be in the biggest ever category.

The point about hitting Q is that I think he would have to be fair about it. Firstly if the evidence was given under oath then there are going to be other penalties and those are given by other judges after what are usually trials.

Then in my view these Q witnesses did not wake up one fine morning and simply walk into court. They were prepared and their evidence examined in fine detail and this was done presumably by lawyers. See p 45 line 6 - 22.

It seems to me that Rudi is also annoyed with some of the lawyers. On 29th August 14 Q lawyers are going to appear before a magistrate in Rudis court to address the issue of sanctions.

So it may be that if there is any blame the Court first has to decide how much for the Q and how much for the lawyers.

Just my guesses.

Best,

L
