While there may be no FRAND obligations in the one way licensing of Broadcom's nonessential patents, since Qualcomm's numerous existing licenses include essential and nonessential IPR, and access to the portfolio of both from the licensee, it is arguable that Qualcomm can require the same from Broadcom. If Broadcom insists on separate licenses for their individual patents, so can Qualcomm, and the valuation model of Broadcom can be applied on a reciprocal basis. Additionally, since Broadcom is seeking equity (i.e. injunction), they must do equity, irrespective of their obligations at law.
