I see that in the case in IN the teacher (teachers aide actually) did sue and win backpay.

I also see that things can vary on a state by state basis:

I think very few cases ever get to court. In my hometown a couple years ago, a group like the ACLU threatened the middle school with a suit if it didn't remove a reproduction of a painting by Da Vinci that had hung in a school hallway or library for over 40 years. It had a religious theme as most art from the period did and that was the basis for the complaint. I'd describe it to you but can't remember it. The school caved in and removed it - hardly anyone can afford to fight stuff like this.
