Art, the following taken from CIBC report dtd 8/17/07.

Buyback unchanged–Qualcomm indicated that a large opportunistic share
buyback is unlikely. The company is committed to the in-place $3B 10b-5
repurchase program, which suggests steady, planned activity, although
there are certain events that can adjust the pace of purchases.

The following taken from QCOM PR dtd 5/27/07.

Repurchases may be made in the open market, through 10b5-1 programs, in privately negotiated transactions, or through the use of derivative securities.

I think open market transactions would be appropriate, but your line of reasoning does make you wonder.
