Acceptance of an insufficient amount, not in conformity with existing contractual terms, might have evidenced a "novation", and given claim to new terms. That is why Qualcomm had to reject the tender. On the other hand, whether under the specific terms of the existing license, Nokia has through conduct triggered a renewal, is squarely before the arbitrator. As we have no access to the license, and have not briefed the controlling law, we have to take the parties at their word - a good faith dispute exists, that must be adjuducated.
