...a securities fraud plot to take strategic investment advantage of law enforcement information contained in FBI
files. The investigation of that plot resulted in the
successful prosecution of Amr Elgindy and others:
• Amr Elgindy, Jeffrey Royer, Troy Peters, Jonathan Dawes,
Lynn Wingate, Derrick Cleveland and Robert Hansen were
charged in the Eastern District of New York with RICO
conspiracy, insider trading, and conspiracies involving
securities fraud and obstruction of justice, among other
charges, in a case involving stock market manipulation and
obstruction of justice which began as an investigation into
whether foreknowledge of the September 11 attacks resulted in
capital market manipulation. Two of the defendants, Cleveland
and Hansen, pled guilty and testified against Elgindy and
Royer. On January 24, 2005, the jury returned a verdict,
convicting Elgindy of racketeering, securities fraud and
extortion, and convicting Royer of racketeering, securities
fraud, obstruction of justice and witness tampering. Wingate
also pled guilty and Peters awaits trial. On June 19, 2006,
Elgindy was sentenced to 108 months in prison on these
charges and an additional 27 consecutive months on a separate
indictment for false statements and committing an offense
while on release.
