Seriously .. I keep a digital recorder next to me any time I drive.

I don't care for that "he said/she said" crap.

For the driver to be charged like that is a clear case of abuse of police power.

1) A voice recorder on the seat is tapping no "wire communication". That charge is utterly bogus.
2) With the motor running (or even just having the keys in the car with him), he is guilty of DUI in most, if not all, states. If you want to sleep it off in your car, hide the keys outside the car.
