I don't think being under the influence of any substance relieves one of the responsibility of behavior and actions.

If drugs were legalized, I would not like to see a new defense for perpetrators of crimes arise out of it.

They don't? People can go to the Liquor Store and buy whatever they please. In some states, they can buy it at their local grocery or drug store. So if drugs are legalized, how would anyone get them if not buying them at State stores, or with State permission.

Everything available at your local pharmacy is legal, but requires prescription. Legal does not mean without restriction.

And what would the penalties be for the bad behaviors and/or criminal activities that will happen when the 1 in 10 becomes addicted to them?

The same as the penalties for people addicted to prescription drugs.
