I wouldn't know. But I think there are various escape clauses in Federal contracts with provisions for "best available technology" and other some such. In budgets of hundreds of billions, many exceptions are made under the guise of urgent need, etc.... Nobody would care if a subsequent upgrade contract is issued for a couple million bucks.
