life is uncertain,, market is uncertain. sometimes you take risks and get rewarded sometimes we get burnt.

perhaps uncertainty, because ho hum.. and analysts after another good earnings quarter realize their is more to qcom than court procedings.. this may just be a way of life for the future.

Without commenting on your "waiver" assertion, which I have difficulty accepting, don't forget that the battery conservation patent at issue in the ITC proceeding expires in less than 1 1/2 years, thereby rendering the "obviousness" issue academic and moot. The appellate process should outlive the patent.

I'm not sure I agree with you.

1) BRCM has publicly stated that they will have a WCDMA chip ready by the end of 2008. They must have a license by then. If the appeal can be delayed for 9 to 18 months, which is what I read, then BRCM is SOL.

2) In 9 to 18 months QUALCOMM had better have an adequate work around (approved by the ITC as non-infringing) by that time.
