I completely agree with them.

I'm usually on the defense side in civil litigation, but have
represented plaintiffs as well. I talk to my plaintiffs like a Dutch auntie<g>. I carefully explain to them the facts of life about litigation and what can happen if they don't prevail.

I've also been a mediator for almost 10 years. I can't tell you the number of times I've heard the tune that "I'll just go to court" if a plaintiff can't get what s/he wants in the settlement process. I explain that any case can be lost, trial can be expensive, and that they could end up owing money.

I won the first case I tried (12-0), after offering $50,000 to the plaintiffs in a pre-trial statutory offer against their $400,000 demand. My client was awarded nearly $25,000 in costs, which I collected within a short time after entry of the judgment. Those two plaintiffs were shocked and initiated bar proceedings as well as litigation against their lawyers. That was in the early 80's, but it makes me shudder even now.:)
