I don't think the Big government bureaucrats behind the Patriot Act were all that concerned about the borders when they introduced the (latest version of) the Act and it's aggrandizement of the bureaucracies.

(Though the issue of 'the borders' makes for a convenient talking point to help in selling the new powers for the government bureaucracies.)
