I think WCOM and Enron led to the creation of the enron task force which is employing these new techniques though. I don't think they had to lie to get anybody at Enron or WCOM, the facts were right out there. But the new cases they are trying are a lot more nebulous- I guess they think they can't win without prosecutorial fancy footwork which is a euphemism for falsely accusing people. I am only very familiar with the backdating case, because it was here, but then when I started reading the blogs apparently the Conrad Black case (Hollinger intl) was also a lot of yellow prosecutorial work (according to the blogs). Thats why I wanted to know about Cendant.
