The facts that are of consequence to the determination of the Motion are whether “current management” engaged in fraud, dishonesty, incompetence, or gross mismanagement. Bishop is the current management of the Debtor. The acts of prior management are of no consequence.

Very creative. First Atty Kennedy conveniently overlooks grounds two and three for reasons to appoint a Chapter 11 Trustee, then says you can't use the "because he's a crook" rationale because it only applies to current management which is no longer the case because Turek has resigned.

Not gonna fly, IMO, for a host of reasons. But, even still, the .000001% chance of Turek pulling a miracle out of his hat as far as common shareholders are concerned has now been officially extinguished.
