"Second I have in my hand here copies of several articles that Mark Hulbert published over the internet that disclose information found in your newsletter. Have you terminated Mr. Hulbert's subscription? If not could you please explain to this court why you are treating him differently than my client."

Why would that be considered relevant? Does "But Mom, Johnny did it too" really work in court?

Good luck with that joe, but if I had to guess (some people seem to think I'm clairvoyant) I'd guess that James is not going to sue and neither is Brinker. It's not worth it, for either of them. JMO. :)
