APPLICATION TO EMPLOY AUCTIONEER

Comes the trustee, Stephen Palmer, and respectfully represents to the Court as follows:

1. That an Order for Relief was entered herein under Chapter 11 of Title 11 U.S. Code on May 16, 2007

2. That the applicant was appointed Interim Trustee by Order of this Court dated October 5, 2007 and the applicant accepted such appointment on October 5, 2007.

3. That the applicant desires to employ James J. Bates, Thompson and Riley, Ltd., 714 East Main Street, Lexington, Fayette County, Kentucky to sell certain non-exempt personal
property listed by the debtor in the petition at auction.

4. That it is necessary to employ an auctioneer to sell the personal property of the debtor, and an auction appears to be the most reasonable and least expensive way to liquidate this property to wit: office furniture.

5. That James J. Bates is qualified as a licensed auctioneer and appraiser and has conducted auctions and appraisals for many years in this community. Mr. Bates is bonded in the
amount of $50,000.00 in favor of the United States of America, U.S. Department of Justice by the Carpenter-Warren Insurance Agency through December 22, 2007.

6. That the above-named auctioneer has agreed to sell the above-listed property for a fee of 10 % of the selling price of the property listed above with all expenses of advertising and conducting the auction to be borne by the auctioneer.

7. To the best of the applicant' s knowledge, the members and associates of the firm of Thompson and Riley, Ltd. do not have any connection with the trustee, the debtor, any creditors,
or any other party in interest, or their respective attorneys or accountants, and represents that there is no interest adverse to the estate in the matter upon which it is to be retained.

WHEREFORE, the applicant requests the entry of an Order authorizing him to retain Thompson and Riley, Ltd. as auctioneer to sell the property described herein on the terms of compensation set forth above.
