Funny, I was reading a great deal of CEO product launches and not one was downplayed as "risky". even more amusing (and I was just reading it in the Overstock Conference call discussing the launch) Was the Securities Act Safe Harbor Agreement regarding forward looking statements. Apparently such safe harbor does not apply to Byrne and what Rocker wants to imply by saying such is that Byrne was actually launching a product he knew would not be successful.

Jeff, you are really too funny. I remember a few years back where GM made a 10 year forward looking statement about HUGE growth. Six months later they were in trouble and they downplayed the future growth without ever mentioning their prior statements.

Future is a funny thing you know, today you are healthy and tomorrow you are lying on a cold slab in the morgue - who saw it coming but come it did. Just ask the families of those healthy people that turn up dead tomorrow.

Have written to Sam plenty of times, Sam apparently moderates his comments as well. Funny though, Sam has no real proof of what the SEC is looking into regarding Byrne and Overstock but talk about it he does. Sam has no idea whether the case is still open or in a state of dormancy like the other 3600 cases the SEC still holds open but are dormant.

I am amused at how Sam and rocker go at this like a child who had his feelings hurt because somebody called them a jerk. I guess Sam never read any of the berating memo's Rocker sent to Corporate Boards or CEO's when he wanted to be an activist hedge fund investor with a short position. Of course Sam does not want to discuss the Rocker compliants filed with the SEC about TASER that never yielded anything either. Or the one about Netflix or Navarre. No, Rocker had privaledge to file those frivolous complaints that manipulated the stock price down but for Byrne to file a complaint against Rocker - heaven forbid. He is David Rocker how dare Byrne show such disrespect.

He who lives in Glass houses....

Rocker found somebody willing to play by the rules Rocker plays to and suddenly he finds himself upset. Turn around is fair play and in this case the tables are turned on Rocker. (Remember, there is still that issue of harassment up in Canada regarding the Fairfax CEO)
