That's part of the justification for high tax rates in the top income brackets. Those tax payers can and do take advantage of all the deductions available to them. The argument goes that government should make up for it by taxing the non-deductible income at a higher rate.

A more sensible argument would be for the elimination of said deductions, but it's a whole lot easier for guys like Ted to speak from the heart and say that the rich simply ought to pay their "fair share."
