The question, as I understood it, was not one of context but one of principle. What is torture and what is not torture. If it is one of context then it should be addressed in that manner as a legal issue, but it hasn't been. Personally I think it is not resolvable in the mode of discussion. However, If you want to present your AQ terrorist as context then I have every right to challenge that with my ten year old little girl as context. If one qualifies the question then so does the other; if not one then not the other.
